The Declaration of Covenants, Conditions, and Restrictions (CC&Rs) is the legal document that defines the laws for which the planned community has agreed to abide. The CC&Rs focus on the responsibilities of all homeowners, restrict how our properties are utilized, cites maintenance requirements and defines other similar obligations. They are recorded in the Maricopa County Recorder’s Office and are legally binding.

Bylaws
The Bylaws ensure that the HOA functions fully as a business entity under the umbrella of a governing group of the members. It explains how those members are appointed or elected, what inherent responsibilities they have, how and when gatherings of the community must occur, and other pertinent legal parameters of the association. It is a definitive document, equal to that of the CC&Rs.
Rules & Guidelines
The Rules & Architectural Guidelines are both a summary or clarification of the Use Restrictions and City & State Ordinances contained in the recorded documents, as well as a detailed criteria in community design, limitations and enforcement. These regulations are amended from time to time, as societies evolve and laws change, and should be carefully perused by all those residing at Somner Place.
